Privacy Policy — Monika Zapisek Studio

Who is the controller of your data?

The controller of your personal data is Monika Zapisek Studio, with its registered office in Warsaw (registered address: ul. Peszteńska 3 m. 33, 03-925 Warsaw), NIP: 7010128633, REGON: 524026755.

Why do we process your data?

  • In connection with the services provided by Monika Zapisek Studio (hereinafter: MZ Studio) relating to graphic design, i.e. for the purpose of concluding or performing a contract (Article 6(1)(b) of the Regulation), your data will be stored until the contract has been performed.
  • For the purposes of marketing and promoting the products offered by MZ Studio, based in Warsaw, which constitutes a legitimate interest of MZ Studio (Article 6(1)(f) of the Regulation), your data will be processed until you object.
  • In connection with MZ Studio’s obligation to fulfil all legal obligations arising from the cooperation undertaken (Article 6(1)(c) of the Regulation). This purpose relates to the legal obligation to retain certain documents for the period specified by law, for example:
    • Article 74(2)(1–8) of the Accounting Act of 29 September 1994 (Journal of Laws of 2017, item 1858);
    • Article 8b(3) in conjunction with Article 9k of the Act of 16 November 2000 on Counteracting Money Laundering and Terrorist Financing (Journal of Laws 2000, No. 116, item 1216);
    • Article 86(1) and (2) of the Act of 29 August 1997 — Tax Ordinance (Journal of Laws 1997, No. 137, item 926).
    • For the possible establishment, exercise or defence of claims, which is our legitimate interest (basis: Article 6(1)(f) of the Regulation). The data will be processed until the claims become time-barred.
    • Where consent has been given, your data will be processed within the scope and for the purpose specified in that consent (basis: Article 6(1)(a)). The data will be processed until consent is withdrawn.

What data is processed?

To conclude a contract, you must provide the data indicated on the contract/order form (if you do not provide it, we will not conclude the contract or fulfil the order). In addition, MZ Studio may ask for optional data that has no bearing on concluding the contract (if we do not receive it, we will not be able to, for example, call your contact number). During the term of the contract, in the course of providing our services, we come into possession of further data concerning you. Your personal data reaching us is a consequence of the operation of the services you use.

Who will the data be shared with?

  • Public authorities, to the extent that they do not receive the data as part of specific proceedings under the law;
  • Entities that process your personal data on behalf of MZ Studio under a data processing agreement concluded with MZ Studio (so-called processors). These include, among others: IT specialists, archiving companies, providers of banking and payment services, and hosting companies;
  • External data controllers (so-called Parallel Controllers, to whom the data is made available, e.g. legal counsel and attorneys, courier or postal operators, entities acquiring receivables — in the event that you fail to pay our invoices on time).

Is the data profiled?

We inform you that your data will not be subject to profiling, i.e. the automated analysis of your data and the formulation of predictions about your preferences or future behaviour (profiling means, for example, in the case of marketing profiling, determining which offer you might be most interested in based on your earlier choices).

What rights do you have?

  • The right of access to the personal data we process (Article 15 of the Regulation),
  • The right to rectification of the personal data entrusted to us, including its correction (Article 16 of the Regulation),
  • The right to erasure of personal data from our systems, the so-called “right to be forgotten” — if in your view there are no grounds for us to process your data, you may request that we delete it (Article 17 of the Regulation),
  • The right to restriction of processing — you may request that we restrict the processing of your personal data solely to its storage or to carrying out actions agreed with you, if we hold incorrect data about you or process it without grounds; or if you do not want us to delete it because you need it to establish, exercise or defend claims; or for the duration of an objection you have raised against the processing (Article 18 of the Regulation),
  • The right to data portability — you have the right to receive from us, in a structured, commonly used, machine-readable format (e.g. “.csv”), the personal data concerning you that we hold on the basis of a contract or your consent. This right applies where we hold the data in electronic form — if we hold the data only on paper, you will not be able to exercise it. You may instruct us to transmit that data directly to another entity (Article 20 of the Regulation),
  • The right to withdraw consent to the processing of personal data — at any time you have the right to withdraw consent to the processing of personal data that we process on the basis of consent (Article 7(3) of the Regulation). Withdrawing consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal. Consent is withdrawn by sending an email to: studio@monikazapisek.com
  • The right to object — you may object to the processing of your data where the basis for using it is our legitimate interest (Article 21 of the Regulation). In that case, after considering your request, we will no longer be able to process the personal data covered by the objection on that basis, unless we demonstrate the existence of compelling legitimate grounds for the processing which override your interests, rights and freedoms.
  • If, in your opinion, the processing of personal data infringes the provisions of the Regulation, you have the right to lodge a complaint with the supervisory authority, i.e. the President of the Personal Data Protection Office.
